She is classified as a protection agency. state secrets in accordance with the law “OGT” of July 21, 1993, article 20.

In accordance with the presidential decree of March 30, 1994, its functions were temporarily assigned to the State Technical Commission under the President of the Russian Federation. The interdepartmental commission was created in accordance with the presidential decree of November 8, 1995. The regulations on the commission were approved by presidential decree of January 20, 1996. The current regulations on the commission were approved by decree of the President of Russia of October 6, 2004.

Interdepartmental commission - collegial body, whose main function is to coordinate the activities of federal bodies state power and state authorities of the constituent entities of the Russian Federation (hereinafter referred to as state authorities) for the protection of state secrets in the interests of developing and implementing state programs, normative and methodological documents ensuring the implementation of federal legislation on state secrets.

The interdepartmental commission also carries out the function of declassifying documents created by the CPSU.

When carrying out its activities, the interdepartmental commission has the right:

create a list of officials of public authorities vested with the authority to classify information as state secrets;

create a list of information classified as state secrets;

prepare proposals for organizing development and implementation government programs, normative and methodological documents ensuring the implementation of federal legislation on state secrets, and submit them in the prescribed manner to the Government of the Russian Federation;

consider and submit, in the prescribed manner, to the President of the Russian Federation and the Government of the Russian Federation proposals for legal regulation issues of protecting state secrets and improving the system for protecting state secrets in the Russian Federation; determine the procedure for declassifying carriers of information constituting state secrets in the event of liquidation of the fund-forming organization and the absence of its legal successor;

organize the work of interdepartmental expert groups on declassification and extension of the terms of classification of documents of the CPSU, the Government of the USSR and other archival documents in the absence of the fund-forming organization and its legal successor;

consider, in cases provided for by the Law of the Russian Federation "On State Secrets", requests from public authorities, bodies local government, enterprises, institutions, organizations and citizens on the declassification of information classified as state secrets;

prepare expert opinions on documents containing information classified as state secrets in order to resolve the issue of the possibility of transferring this information to other states and submit these conclusions in the prescribed manner to the Government of the Russian Federation for decision-making;

make decisions on the transfer by a state authority, local government body, enterprise, institution and organization of information constituting a state secret, in cases of change in their functions, forms of ownership, liquidation or termination of work using information constituting a state secret, to another state authority, body local government, enterprise, institution, organization;

prepare and submit, in the prescribed manner, to the Government of the Russian Federation proposals on the procedure for determining the extent of damage that may be caused to the security of the Russian Federation due to the unauthorized dissemination of information constituting state secrets, as well as damage caused to enterprises, institutions, organizations and citizens in connection with the classification of information , located in their property;

prepare and submit, in the prescribed manner, to the Government of the Russian Federation proposals on the rules for classifying information constituting a state secret to various degrees of secrecy;

to consider, on instructions from the President of the Russian Federation and the Government of the Russian Federation, expert opinions in order to determine the extent of possible damage that could be caused to the security of the Russian Federation due to the unauthorized dissemination of information constituting state secrets, as well as damage caused to enterprises, institutions, organizations and citizens in connection with classifying information in their possession;

consider, on instructions from the President of the Russian Federation and the Government of the Russian Federation, draft international treaties of the Russian Federation on the joint use and protection of information constituting state secrets, prepare relevant proposals and expert opinions, and participate in international cooperation on these issues;

give opinions on decisions of heads of government bodies related to changes in the lists of information subject to classification in government bodies, local governments, enterprises, institutions and organizations, which may lead to changes in the list of information classified as state secrets, suspend or appeal their decisions;

coordinate work on organizing certification of information security tools;

coordinate in the prescribed manner the work on licensing the activities of enterprises, institutions and organizations related to the use of information constituting state secrets, the creation of means of protecting information, as well as the implementation of measures and (or) provision of services to protect state secrets;

resolve the issue of extending the 30-year period for classifying information constituting state secrets;

consider, on instructions from the President of the Russian Federation and the Government of the Russian Federation, other issues in accordance with by law Russian Federation "On State Secrets".

The interdepartmental commission is headed by a chairman who has two deputies. The Chairman of the Interdepartmental Commission and his deputies are appointed and dismissed by the President of the Russian Federation.

The Interdepartmental Commission includes heads of federal executive authorities, the Administration of the President of the Russian Federation, the Office of the Government of the Russian Federation or their deputies.

The Interdepartmental Commission may, upon agreement, include:

First Deputy Chief of Staff of the Federation Council;

First Deputy Chief of Staff of the State Duma;

First Deputy Chairman Supreme Court Russian Federation;

first Deputy Prosecutor General Russian Federation.

The composition of the Interdepartmental Commission by position is approved by the President of the Russian Federation, and the personnel composition is approved by the Government of the Russian Federation.

The executive secretary of the Interdepartmental Commission is the deputy chairman of the State Technical Commission under the President of the Russian Federation.

As structural divisions of the Interdepartmental Commission, decisions of the President of the Russian Federation may create commissions for specific areas of work.

Organizational and technical support for the activities of the Interdepartmental Commission is carried out by the central apparatus of the State Technical Commission under the President of the Russian Federation, in which a structural unit is created to perform these functions.

Chairman of the Interdepartmental Commission:

requests and receives in due course from government agencies, local government bodies, enterprises, institutions, organizations, officials and citizens information, documents and materials necessary for the implementation of the activities of the Interdepartmental Commission;

creates interdepartmental working and expert groups to ensure the activities of the Interdepartmental Commission;

attracts on a contractual basis state and non-state enterprises, organizations and institutions, as well as individual specialists to perform analytical, research and expert work;

entrusts the preparation and holding of meetings of the Interdepartmental Commission to his deputies.

Decisions of the Interdepartmental Commission, adopted in accordance with its powers, are binding on state authorities, local governments, enterprises, institutions, organizations, officials and citizens.

Decisions of the Interdepartmental Commission, if necessary, are submitted to the President of the Russian Federation, to the Government of the Russian Federation, and are also sent (insofar as they are concerned) to state authorities, state authorities of the constituent entities of the Russian Federation, local governments, enterprises, institutions and organizations, regardless of their organizational and legal forms and forms of ownership.

If necessary, based on decisions of the Interdepartmental Commission adopted in accordance with these Regulations, draft decrees and orders of the President of the Russian Federation, decrees and orders of the Government of the Russian Federation may be developed, which are submitted for consideration in the prescribed manner.

Powers of the interdepartmental commission for the protection of state secrets:

Formation of a list of officials of public authorities vested with the authority to classify information as state secrets.

Formation of a list of information related to GT.

Formation of a list of special regime facilities in Russia and its submission to the government.

Determining the procedure for declassifying information carriers related to GT.

Declassification and extension of the deadlines for classifying documents of the CPSU, the government of the USSR and other archival documents in the absence of a fund-forming organization and a legal successor to such an organization.

Preparation of expert opinions on the possibility of transferring protected information to other states and organizations.

Preparation of proposals and expert opinions on issues international cooperation in the field of GT protection.

Preparation of proposals on the rules for classifying information constituting GT to various degrees of secrecy.

Consideration of expert opinions in order to determine the extent of possible damage as a result of unauthorized dissemination of information and damage caused to organizations and citizens.

Coordinates work on organizing certification of information security tools.

Coordinates the work on licensing the activities of enterprises related to the use of information constituting GT, the creation of RI tools, as well as the provision of services for the protection of GT.

Resolves the issue of extending the thirty-year period of classification of information constituting GT.

Coordinates activities in the field of training, retraining and advanced training of specialists in the field of GT protection.

Organizational and technical support for the commission’s activities is provided by the FSTEC apparatus.

1. Approve the attached composition of the Interdepartmental Commission for the Protection of State Secrets.
