GOVERNMENT OF THE RUSSIAN FEDERATION DECISION of June 17, 2004 No. 292 Moscow On the Federal Agency for Press and Mass Communications The Government of the Russian Federation decides: 1. To approve the attached Regulations on the Federal Agency for Press and Mass Communications. 2. To establish that, until the Government of the Russian Federation approves the list of subordinate organizations of federal executive authorities, the jurisdiction of the Federal Agency for Press and Mass Communications includes organizations that were under the jurisdiction of the Ministry of the Russian Federation for Press, Television and Radio Broadcasting and Mass Communications. 3. Include in the resolution of the Government of the Russian Federation of April 8, 2004. No. 193 “Issues of the Federal Agency for Press and Mass Communications” (Collection of Legislation of the Russian Federation, 2004, No. 15, Art. 1485) the following changes: 1) paragraphs 3, 4 and 6 are deleted; 2) in paragraph 8 the words: “and the maximum number of employees of its territorial bodies in the amount of 106 units (without personnel for security and maintenance of buildings)” should be deleted; 3) in paragraph 9 the words: “Malaya Nikitskaya St., 12” should be deleted. No. 292 REGULATIONS on the Federal Agency for Press and Mass Communications I. General provisions 1. The Federal Agency for Press and Mass Communications is a federal executive body that carries out the functions of providing public services, managing state property in the field of press, media and mass media. communications, including public computer networks in the field of electronic media, publishing and printing activities. 2. The Federal Agency for Press and Mass Communications carries out its activities directly and through subordinate organizations in interaction with other federal executive authorities, executive authorities of constituent entities of the Russian Federation, local government bodies, public associations and other organizations. II Powers 5. The Federal Agency for Press and Mass Communications exercises the following powers in the established field of activity: 5.1. conducts competitions in accordance with the established procedure and concludes government contracts for placing orders for the supply of goods, performance of work, provision of services, for carrying out research, development and technological work for government needs in the established field of activity, including to meet the needs of the Agency; 5.2. exercises, in the manner and within the limits determined by federal laws, acts of the President of the Russian Federation and the Government of the Russian Federation, the powers of the owner in relation to federal property necessary to ensure the performance of the functions of federal government bodies in the field of activity established by paragraph 1 of these Regulations, including property transferred federal state unitary enterprises, federal state institutions and state-owned enterprises subordinate to the Agency; 5.3. organizes measurements of the audience of electronic media and analysis of circulation of print media; 5.4. carries out: 5.4.1. compiling a collection of mandatory free copies of printed publications; 5.4.2. holding script competitions to create socially significant television and radio programs, television and animated films; 5.5. prepares proposals for carrying out work to find new radio frequency channels and develop the radio frequency spectrum and orbital positions of satellites for the purposes of television and radio broadcasting, development of mass communications and media dissemination; 5.6. maintains unified all-Russian registers of mass media; 5.1. makes, in accordance with the legislation of the Russian Federation, decisions on the management of the federally owned fund of completed production and broadcast television and radio programs, broadcasts, phonograms, as well as other audiovisual works (with the exception of films); 5.8. carries out an economic analysis of the activities of subordinate state unitary enterprises and approves the economic indicators of their activities, conducts audits of financial and economic activities and use of the property complex in subordinate organizations; 5.9. carries out the functions of the state customer of federal target, scientific, technical and innovative programs and projects in the established field of activity; 5. 10. in accordance with the established procedure, interacts with government authorities of foreign states and international organizations in the established field of activity; 5.11. receives citizens, ensures timely and complete consideration of oral and written requests from citizens, makes decisions on them and sends responses to applicants within the period established by the legislation of the Russian Federation; 5.12. ensures, within its competence, the protection of information constituting state secrets; 5.13. ensures mobilization preparation of the Agency, as well as control and coordination of the activities of mobilization preparation organizations under its jurisdiction; 5.14. organizes professional training for the Agency’s staff, their retraining, advanced training and internships; 5.15. carries out, in accordance with the legislation of the Russian Federation, work on the acquisition, storage, recording and use of archival documents generated in the course of the Agency’s activities; 5.16. carries out the functions of the main manager and recipient of federal budget funds provided for the maintenance of the Agency and the implementation of the functions assigned to the Agency; 5.17. organizes congresses, conferences, seminars, exhibitions and other events in the established field of activity; 5.18. carries out other functions for the management of state property and the provision of public services in the established field of activity, if such functions are provided for by federal laws, regulatory legal acts of the President of the Russian Federation and the Government of the Russian Federation. 6. In order to exercise powers in the established field of activity, the Federal Agency for Press and Mass Communications has the right: 6.1. provide explanations to legal entities and individuals on issues related to the established scope of activity; 6.2. involve scientific and other organizations, scientists and specialists to study issues within the established scope of activity; 6.3. create coordination, advisory and expert bodies (councils, commissions, groups, collegiums) in the established field of activity; 6.4. exercise control over the activities of subordinate organizations. 7. The Federal Agency for Press and Mass Communications does not have the right to carry out legal regulation in the established field of activity and functions of control and supervision, except in cases established by decrees of the President of the Russian Federation or decrees of the Government of the Russian Federation. The restrictions on the Agency's powers established by the first paragraph of this clause do not apply to the powers of the head of the Agency to resolve personnel issues and issues of organizing the activities of the Agency, control the activities in the Agency headed by him (its structural divisions). III. Organization of activities 8. The Federal Agency for Press and Mass Communications is headed by a director appointed and dismissed by the Government of the Russian Federation on the proposal of the Minister of Culture and Mass Communications of the Russian Federation. The head of the Federal Agency for Press and Mass Communications is personally responsible for fulfilling the functions assigned to the Agency. The head of the Federal Agency for Press and Mass Communications has deputies who are appointed and dismissed by the Minister of Culture and Mass Communications of the Russian Federation on the proposal of the head of the Agency. The number of deputy heads of the Federal Agency for Press and Mass Communications is established by the Government of the Russian Federation. 9. Head of the Federal Agency for Press and Mass Communications: 9.1. distributes responsibilities among his deputies; 9.2. submits to the Minister of Culture and Mass Communications of the Russian Federation: 9.2.1. draft regulations on the Agency; 9.2.2. proposals on the maximum number and wage fund of the Agency’s staff; 9.2.3. proposals for the appointment and dismissal of deputy heads of the Agency; 9.2.4. the annual plan and performance indicators of the Agency, as well as a report on its activities; 9.3. approves regulations on the structural divisions of the Agency; 9.4. in accordance with the established procedure, appoints and dismisses employees of the Agency’s apparatus; 9.5. resolves, in accordance with the legislation of the Russian Federation on public service, issues related to the performance of federal public service in the Agency; 9.6. approves the structure and staffing of the Agency's apparatus within the limits of the wage fund and the number of employees established by the Government of the Russian Federation, the cost estimate for the maintenance of the Agency's apparatus within the limits of the appropriations approved for the corresponding period and provided for in the federal budget; 9.7. in the prescribed manner, appoints and dismisses heads of subordinate institutions and other organizations, concludes, changes, terminates employment contracts with these managers, approves the charters of subordinate organizations in the prescribed manner; 9. 8. on the basis and in pursuance of the Constitution of the Russian Federation, federal constitutional laws, federal laws, acts of the President of the Russian Federation. The Government of the Russian Federation and the Ministry of Culture and Mass Communications of the Russian Federation issues orders on issues within the competence of the Agency. 10. The costs of maintaining the Federal Agency for Press and Mass Communications are financed from funds provided in the federal budget. 11. The Federal Agency for Press and Mass Communications is a legal entity, has a seal with the image of the State Emblem of the Russian Federation and with its name, other necessary seals, stamps and forms of the established form, as well as accounts opened in accordance with the legislation of the Russian Federation. 12. The location of the Federal Agency for Press and Mass Communications is Moscow.

I. General provisions

1. The Federal Agency for Press and Mass Communications (Rospechat) is a federal executive body that carries out the functions of providing public services, managing state property in the field of printing, media and mass communications, including public computer networks in the field of electronic media mass information, publishing and printing activities.

II. Authority

5. The Federal Agency for Press and Mass Communications exercises the following powers in the established field of activity:

5.1. carries out, in accordance with the legislation of the Russian Federation and other regulatory legal acts on the contract system in the field of procurement of goods, works, services to ensure state and municipal needs, the purchase of goods, works, services in the established field of activity;

5.2. exercises, in the manner and within the limits determined by federal laws, acts of the President of the Russian Federation and the Government of the Russian Federation, the powers of the owner in relation to federal property necessary to ensure the performance of the functions of federal government bodies in the field of activity established by paragraph 1 of these Regulations, including property transferred federal state unitary enterprises, federal state institutions and state-owned enterprises subordinate to the Agency;

5.3. organizes measurements of the audience of electronic media and analysis of circulation of print media;

5.4. carries out:

5.4.1. compiling a collection of mandatory free copies of printed publications;

5.4.2. providing state support to organizations engaged in the production, distribution and (or) replication of socially significant projects in the field of electronic media, selected in accordance with the criteria established by the Agency, including the creation and maintenance of sites on the Internet that have social or educational significance;

5.4.3. providing state support to organizations producing, distributing and reproducing socially significant projects in the field of print media, selected in accordance with the criteria established by the Agency, publishing publications for the disabled and visually impaired;

5.6. carries out the formation and use of federal information resources in the established field of activity;

5.7. makes, in accordance with the legislation of the Russian Federation, decisions on the management of the federally owned fund of completed production and broadcast television and radio programs, broadcasts, phonograms, as well as other audiovisual works (with the exception of films);

5.8. carries out an economic analysis of the activities of subordinate state unitary enterprises and approves the economic indicators of their activities, conducts audits of financial and economic activities and use of the property complex in subordinate organizations;

5.9. carries out the functions of the state customer of federal target, scientific, technical and innovative programs and projects in the established field of activity;

5.13. ensures mobilization preparation of the Agency, as well as control and coordination of the activities of mobilization preparation organizations under its jurisdiction;

5.13.1. organizes and conducts civil defense in the Agency;

5.14.1. establishes the procedure and timing for certification of candidates for the position of head of educational organizations subordinate to the Agency, and heads of these organizations;

5.15. carries out, in accordance with the legislation of the Russian Federation, work on the acquisition, storage, recording and use of archival documents generated in the course of the Agency’s activities;

5.16. carries out the functions of the main manager and recipient of federal budget funds provided for the maintenance of the Agency and the implementation of the functions assigned to the Agency;

5.17. organizes congresses, conferences, seminars, exhibitions and other events in the established field of activity;

5.17.1. implements measures to support small and medium-sized businesses aimed at their development, including the implementation of relevant departmental target programs in the established field of activity;

5.18. carries out other functions for the management of state property and the provision of public services in the established field of activity, if such functions are provided for by federal laws, regulatory legal acts of the President of the Russian Federation and the Government of the Russian Federation.

6. In order to exercise powers in the established field of activity, the Federal Agency for Press and Mass Communications has the right:

9.2.2. proposals on the maximum number and wage fund of the Agency’s staff;

9.2.3. proposals for the appointment and dismissal of deputy heads of the Agency;

9.2.4. the annual plan and performance indicators of the Agency, as well as a report on its activities;

9.2.5. proposals for presentation of state awards of the Russian Federation, Certificate of Honor of the President of the Russian Federation, Certificate of Honor of the Government of the Russian Federation, for encouragement in the form of an announcement of gratitude from the President of the Russian Federation, an announcement of gratitude from the Government of the Russian Federation, for awarding a departmental insignia of the Ministry of Digital Development, Communications and Mass Media communications of the Russian Federation, giving the right to confer the title "Veteran of Labor" to employees of the Agency and subordinate organizations, as well as other persons operating in the established field;

9.3. approves regulations on the structural divisions of the Agency;

9.4. in accordance with the established procedure, appoints and dismisses employees of the Agency’s apparatus;

9.5. resolves, in accordance with the legislation of the Russian Federation on public service, issues related to the performance of federal public service in the Agency;

9.6. approves the structure and staffing of the Agency's apparatus within the limits of the wage fund and the number of employees established by the Government of the Russian Federation, the cost estimate for the maintenance of the Agency's apparatus within the limits of the appropriations approved for the corresponding period and provided for in the federal budget;

9.7. in the prescribed manner, appoints and dismisses heads of subordinate institutions and other organizations, concludes, changes, terminates employment contracts with these managers, approves the charters of subordinate organizations in the prescribed manner;

10. The costs of maintaining the Federal Agency for Press and Mass Communications are financed from funds provided in the federal budget.

11. The Federal Agency for Press and Mass Communications is a legal entity, has a seal with the image of the State Emblem of the Russian Federation and with its name, other necessary seals, stamps and forms of the established form, as well as accounts opened in accordance with the legislation of the Russian Federation.

The Federal Agency for Press and Mass Communications has the right to have a heraldic sign - an emblem, a flag and a pennant, established by the Ministry of Digital Development, Communications and Mass Communications of the Russian Federation in agreement with the Heraldic Council under the President of the Russian Federation.

12. The location of the Federal Agency for Press and Mass Communications is Moscow.

9.7. in the prescribed manner, appoints and dismisses heads of subordinate institutions and other organizations, concludes, changes, terminates employment contracts with these managers, approves the charters of subordinate organizations in the prescribed manner;

9.8. on the basis and in pursuance of the Constitution of the Russian Federation, federal constitutional laws, federal laws, acts of the President of the Russian Federation, the Government of the Russian Federation and the Ministry of Culture and Mass Communications of the Russian Federation, issues orders on issues within the competence of the Agency.

10. The costs of maintaining the Federal Agency for Press and Mass Communications are financed from funds provided in the federal budget.

11. The Federal Agency for Press and Mass Communications is a legal entity, has a seal with the image of the State Emblem of the Russian Federation and with its name, other necessary seals, stamps and forms of the established form, as well as accounts opened in accordance with the legislation of the Russian Federation.

Government of the Russian Federation

decides:

1. Approve the attached Regulations on the Federal Agency for Press and Mass Communications.

2. To establish that, until the Government of the Russian Federation approves the list of subordinate organizations of federal executive authorities, the jurisdiction of the Federal Agency for Press and Mass Communications includes organizations that were under the jurisdiction of the Ministry of the Russian Federation for Press, Television and Radio Broadcasting and Mass Communications.

3. Introduce the following changes to the Decree of the Government of the Russian Federation of April 8, 2004 N 193 “Issues of the Federal Agency for Press and Mass Communications” (Collection of Legislation of the Russian Federation, 2004, N 15, Art. 1485):

1) paragraphs 3, and delete;

2) the subparagraph has lost force - Decree of the Government of the Russian Federation of January 28, 2011 N 39;

3) in paragraph 9 the words: “Malaya Nikitskaya St., 12” should be deleted.

I. General provisions

1. The Federal Agency for Press and Mass Communications (Rospechat) is a federal executive body that carries out the functions of providing public services, managing state property in the field of printing, media and mass communications, including public computer networks in the field of electronic media mass information, publishing and printing activities (clause supplemented by Decree of the Government of the Russian Federation of June 2, 2008 N 415. *1)

2. The Federal Agency for Press and Mass Communications is under the jurisdiction of the Ministry of Digital Development, Communications and Mass Communications of the Russian Federation.

3. The Federal Agency for Press and Mass Communications is guided in its activities by the Constitution of the Russian Federation, federal constitutional laws, federal laws, acts of the President of the Russian Federation and the Government of the Russian Federation, international treaties of the Russian Federation, regulatory legal acts of the Ministry of Digital Development, Communications and Mass Communications of the Russian Federation Federation, as well as these Regulations.

4. The Federal Agency for Press and Mass Communications carries out its activities directly and through subordinate organizations in interaction with other federal executive authorities, executive authorities of constituent entities of the Russian Federation, local government bodies, public associations and other organizations.

II. Authority

5. The Federal Agency for Press and Mass Communications exercises the following powers in the established field of activity: *5)

5.1. carries out, in accordance with the legislation of the Russian Federation and other regulatory legal acts on the contract system in the field of procurement of goods, works, services to ensure state and municipal needs, the purchase of goods, works, services in the established field of activity;

5.2. exercises, in the manner and within the limits determined by federal laws, acts of the President of the Russian Federation and the Government of the Russian Federation, the powers of the owner in relation to federal property necessary to ensure the performance of the functions of federal government bodies in the field of activity established by paragraph 1 of these Regulations, including property transferred federal state unitary enterprises, federal state institutions and state-owned enterprises subordinate to the Agency;

5.3. organizes measurements of the audience of electronic media and analysis of circulation of printed media; *5.3)

5.4. carries out:

5.4.1. compiling a collection of mandatory free copies of printed publications;

5.4.2. providing state support to organizations engaged in the production, distribution and (or) replication of socially significant projects in the field of electronic media, selected in accordance with the criteria established by the Agency, including the creation and maintenance of sites on the Internet that have social or educational significance;

5.4.3. providing state support to organizations producing, distributing and reproducing socially significant projects in the field of print media, selected in accordance with the criteria established by the Agency, publishing publications for the disabled and visually impaired;

5.5. the subparagraph was excluded from June 22, 2007 by Decree of the Government of the Russian Federation of June 6, 2007 N 354;

5.6. carries out the formation and use of federal information resources in the established field of activity (clause as amended, put into effect on February 17, 2007 by Decree of the Government of the Russian Federation of February 5, 2007 N 78;

5.7. makes, in accordance with the legislation of the Russian Federation, decisions on the management of the federally owned fund of completed production and broadcast television and radio programs, broadcasts, phonograms, as well as other audiovisual works (with the exception of films);

5.8. carries out an economic analysis of the activities of subordinate state unitary enterprises and approves the economic indicators of their activities, conducts audits of financial and economic activities and use of the property complex in subordinate organizations;

5.9. carries out the functions of the state customer of federal target, scientific, technical and innovative programs and projects in the established field of activity;

5.10. interacts in the prescribed manner with government authorities of foreign states and international organizations in the established field of activity;

5.11. receives citizens, ensures timely and complete consideration of oral and written requests from citizens, makes decisions on them and sends responses to applicants within the period established by the legislation of the Russian Federation;

5.12. ensures, within its competence, the protection of information constituting state secrets;

5.13. ensures mobilization preparation of the Agency, as well as control and coordination of the activities of mobilization preparation organizations under its jurisdiction;

5.13_1. carries out the organization and conduct of civil defense in the Agency (the subparagraph was additionally included by Decree of the Government of the Russian Federation of June 15, 2010 N 438);

5.14. organizes additional professional education for Agency staff;

5.14_1. establishes the procedure and timing for certification of candidates for the position of head of educational organizations subordinate to the Agency, and heads of these organizations;

5.15. carries out, in accordance with the legislation of the Russian Federation, work on the acquisition, storage, recording and use of archival documents generated in the course of the Agency’s activities;

5.16. carries out the functions of the main manager and recipient of federal budget funds provided for the maintenance of the Agency and the implementation of the functions assigned to the Agency;

5.17. organizes congresses, conferences, seminars, exhibitions and other events in the established field of activity;

5.17_1. implements measures to support small and medium-sized businesses aimed at their development, including the implementation of relevant departmental target programs in the established field of activity (the subparagraph was additionally included on October 30, 2008 by Decree of the Government of the Russian Federation of October 13, 2008 N 753);

5.18. carries out other functions for the management of state property and the provision of public services in the established field of activity, if such functions are provided for by federal laws, regulatory legal acts of the President of the Russian Federation and the Government of the Russian Federation.

6. In order to exercise powers in the established field of activity, the Federal Agency for Press and Mass Communications has the right: *6)

6.1. provide explanations to legal entities and individuals on issues related to the established scope of activity;

6.2. involve scientific and other organizations, scientists and specialists to study issues within the established scope of activity;

6.3. create coordinating, advisory and expert bodies (councils, commissions, groups, collegiums) in the established field of activity; *6.3)

6.4. exercise control over the activities of subordinate organizations.

7. The Federal Agency for Press and Mass Communications does not have the right to carry out legal regulation in the established field of activity and functions of control and supervision, except in cases established by decrees of the President of the Russian Federation or decrees of the Government of the Russian Federation.

The restrictions on the Agency's powers established by the first paragraph of this clause do not apply to the powers of the head of the Agency to resolve personnel issues and issues of organizing the activities of the Agency, control the activities in the Agency headed by him (its structural divisions).

III. Organization of activities

8. The Federal Agency for Press and Mass Communications is headed by a director appointed and dismissed by the Government of the Russian Federation on the proposal of the Minister of Digital Development, Communications and Mass Communications of the Russian Federation.

The head of the Federal Agency for Press and Mass Communications is personally responsible for fulfilling the functions assigned to the Agency.

The head of the Federal Agency for Press and Mass Communications has deputies appointed and dismissed by the Government of the Russian Federation on the proposal of the Minister of Digital Development, Communications and Mass Communications of the Russian Federation.

The number of deputy heads of the Federal Agency for Press and Mass Communications is established by the Government of the Russian Federation.

9. Head of the Federal Agency for Press and Mass Communications:

9.1. distributes responsibilities among his deputies;

9.2. submits to the Minister of Digital Development, Communications and Mass Communications of the Russian Federation:
(Subparagraph as amended by Decree of the Government of the Russian Federation dated June 2, 2008 N 415; as amended, put into effect on October 6, 2018 by Decree of the Government of the Russian Federation dated September 25, 2018 N 1138.

9.2.1. draft regulations on the Agency;

9.2.2. proposals on the maximum number and wage fund of the Agency’s staff;

9.2.3. proposals for the appointment and dismissal of deputy heads of the Agency;

9.2.4. the annual plan and performance indicators of the Agency, as well as a report on its activities;

9.2.5. proposals for presentation of state awards of the Russian Federation, Certificate of Honor of the President of the Russian Federation, Certificate of Honor of the Government of the Russian Federation, for encouragement in the form of an announcement of gratitude from the President of the Russian Federation, an announcement of gratitude from the Government of the Russian Federation, for awarding a departmental insignia of the Ministry of Digital Development, Communications and Mass Media communications of the Russian Federation, giving the right to confer the title "Veteran of Labor" to employees of the Agency and subordinate organizations, as well as other persons operating in the established field;

9.3. approves regulations on the structural divisions of the Agency;

9.4. in accordance with the established procedure, appoints and dismisses employees of the Agency’s apparatus;

9.5. resolves, in accordance with the legislation of the Russian Federation on public service, issues related to the performance of federal public service in the Agency; *9.5)

9.6. approves the structure and staffing of the Agency's apparatus within the limits of the wage fund and the number of employees established by the Government of the Russian Federation, the cost estimate for the maintenance of the Agency's apparatus within the limits of the appropriations approved for the corresponding period and provided for in the federal budget;

9.7. in the prescribed manner, appoints and dismisses heads of subordinate institutions and other organizations, concludes, changes, terminates employment contracts with these managers, approves the charters of subordinate organizations in the prescribed manner;

9.8. on the basis and in pursuance of the Constitution of the Russian Federation, federal constitutional laws, federal laws, acts of the President of the Russian Federation, the Government of the Russian Federation and the Ministry of Digital Development, Communications and Mass Media of the Russian Federation issues orders on issues within the competence of the Agency.

10. The costs of maintaining the Federal Agency for Press and Mass Communications are financed from funds provided in the federal budget.

The Federal Agency for Press and Mass Communications is a legal entity, has a seal with the image of the State Emblem of the Russian Federation and with its name, other necessary seals, stamps and forms of the established form, as well as accounts opened in accordance with the legislation of the Russian Federation.

The Federal Agency for Press and Mass Communications has the right to have a heraldic sign - an emblem, a flag and a pennant, established by the Ministry of Digital Development, Communications and Mass Communications of the Russian Federation in agreement with the Heraldic Council under the President of the Russian Federation.
