It is desirable to analyze (analysis) the game, in which the achievements and shortcomings of individual participants and the entire gaming group are collectively discussed. First of all, we need to note all the positive things that we can build on in future games. The general tone of the discussion should be calm, encouraging, and instilling faith in new achievements.

The tasks of the leader are not limited to the correct conduct of this or that game, but also include preparing students for the correct conduct of games when organizing them independently.

Now let's look at the rights and responsibilities of gambling participants. As mentioned above, gambling participants can take part in gambling ah, both independently and with the participation of the organizer. In this regard, all rights of participants can be divided into the rights and obligations that participants in a gambling game with an organizer and without an organizer have.

The fundamental right of any participant is the right to receive winnings if he is recognized as a winner. The participant has the right to demand receipt of his winnings from the organizer (if he is a party to the agreement) or other participants (if there is no organizer).

In addition to the participant’s basic right to receive winnings, he also has other rights related to gambling. These rights are either directly established by law or arise from the corresponding obligations of the organizer.

Thus, in accordance with paragraph 20 of Decree of the President of the Republic of Belarus No. 548, gambling participants (visitors of gambling establishments) have, among other things, the right to become familiar with the procedure for their admission to the game, as well as the rules of the games. Other rights arise from the obligations of the organizer established in paragraphs 16, 17, 21 of the said Decree. Note that these rights are inherent mainly to participants who play in gambling establishments, that is, if there is an organizer.

As noted earlier, gambling is a bilaterally binding contract. Therefore, in addition to rights, participants in gambling also have responsibilities.

In my opinion, the responsibilities of participants in a gambling game depend on whether there is an organizer or not. However, there are two main responsibilities that all participants have. Firstly, it is the obligation to deposit a certain amount of money (property), that is, to place a bet. This obligation arises from the real nature of this agreement. Secondly, based on the definition of gambling and paragraph 19 of the said Decree, the main responsibility of players is to fulfill this agreement in accordance with the rules established by the gambling establishment. Moreover, these rules must comply with the rules established by law. In the case where the gambling is carried out without an organizer, these rules, in my opinion, must also comply with the law, and if the rules of the gambling are not defined by law - traditional rules one game or another.

Other responsibilities that a participant in a gambling game bears if it is carried out with an organizer, specified in paragraph 18 of the Decree, are mainly related to the rules of conduct in a gambling establishment.

Big amount responsibilities are burdened by participants in a gambling game that is conducted without an organizer. In this case, the main obligation of the organizer - payment of winnings - becomes the joint responsibility of the losing participants. Other responsibilities arise, in my opinion, from the norms of legislation on the gambling business, which, however, do not talk about the organizer, but establish the rules for organizing and conducting gambling. Thus, in accordance with paragraph 17 of Decree of the President of the Republic of Belarus No. 548 of September 20, 1999 “On approval of the procedure for carrying out gambling business on the territory of the Republic of Belarus”, participants are obliged to provide guarantees for the payment of winnings, ensure the safety of players, conduct gambling in the appropriate place and at Participants reach the age of 18.

To summarize the above, we can note the following. Firstly, depending on the subject composition of this agreement, it is possible to distinguish between gambling conducted between the participant and organizer and gambling conducted between individuals (participants). In this case, the organizer may be the Republic of Belarus, an administrative-territorial unit, or a legal entity or entrepreneur who has a special permit (license) to engage in gambling business. And anyone can be a participant individual who has reached the age of 18, or a legal entity when playing with the organizer. Secondly, the subject of gambling, in my opinion, should be considered possible winnings, since only this definition subject in specific amount(specific property). Thirdly, the organizer and participant are endowed with corresponding rights and obligations. Moreover, the responsibilities of the participants depend on the subject composition of the gambling game.

Despite the fact that gambling is a natural contract, the law defines cases of unlawful behavior of parties in a gambling game and liability for such unlawful behavior. The next paragraph will consider what is considered a violation of gambling, liability for these offenses, as well as the procedure for protecting the rights and legitimate interests game participants.

As noted earlier, until 1998, Belarusian legislation had an extremely negative attitude towards gambling. Currently, the law of the Republic of Belarus has moved away from this position, but at the same time it still retains some repressive features in the regulation of this type of contract. It should also be noted that the legal regulation of gambling throughout the world history of its existence, as in our days, has been on the verge of two (and in the Republic of Belarus - three) branches of law: civil and criminal (administrative). This connection between two (three) branches of law is manifested primarily in measures of liability for violations of the gambling procedure. But, due to the fact that this work studies gambling as one of the types of civil obligations, civil liability for violation of gambling will be examined in more detail.

However, I will have to begin considering the types of liability in this area not with civil liability, but with administrative liability. In this regard, it should be noted that the legislation of the Republic of Belarus provides for liability not only for violation of gambling, but primarily for illegal gambling, which entails administrative liability.

First of all, it should be noted that the current code of the Republic of Belarus on administrative offenses establishes in Article 165/1 administrative responsibility for organizing and participating in any gambling. However, the Civil Code of the Republic of Belarus adopted in 1998 and Decree of the President of the Republic of Belarus No. 21 dated December 1, 1998 allows gambling on the territory of the Republic of Belarus. In replacement of this article (without repealing the norm of the Code of Administrative Offenses), Decree No. 21 establishes administrative responsibility for organizing and conducting only prohibited gambling. At the same time, prohibited gambling, in my opinion, should be understood as those gambling, the organization and conduct of which is directly prohibited by paragraph 17 of Decree of the President of the Republic of Belarus No. 548 (although I fully admit that in practice the word “prohibited” will be interpreted as “not directly permitted ").

Before moving on to measures of civil liability, it should also be noted that all the requirements of citizens and legal entities Problems associated with gambling disorders can be divided into two types:

  • 1. claims subject to judicial protection;
  • 2. claims that are not subject to judicial protection.

The first group includes violations and liability for them, which are established in Article 931 and paragraph 5 of Article 932 Civil Code The Republic of Belarus . In accordance with Article 931 of the Civil Code, the claims of persons who took part in games and bets under the influence of deception, violence, threats or a malicious agreement between their representative and the organizer of the games or bets are subject to judicial protection. At the same time, specified violations (which are essentially a type of improper conclusion and execution of a contract) provide not only civil law, but also criminal liability(theft by fraud and other offenses). Civil liability for this violation of gambling occurs, in accordance with Article 180 of the Civil Code of the Republic of Belarus, when the transaction is declared invalid by the court at the request of the victim. In this case, the guilty party is obliged to return everything received under the transaction to the victim, that is, the participant in the game is returned his bet. In addition, the victim is compensated by the other party for actual damages.

Paragraph 5 of Article 932 of the Civil Code of the Republic of Belarus provides for the responsibility of the organizer in the event of failure to fulfill the obligation to pay winnings to persons who, in accordance with the rules of gambling, are recognized as winners. IN in this case, the participant has the right to demand from the organizer (including in court) payment of winnings, as well as compensation for losses caused by violation of the contract by the organizer. That is, in addition to the requirement to pay out winnings. The participant may demand compensation not only for actual damage, but also for lost profits, which, however, cannot be recognized as lost winnings.

Thus, the Civil Code of the Republic of Belarus provides for only two offenses related to gambling, the restoration of violated rights for which can be carried out in court. However, the Civil Code of the Republic of Belarus also provides for other gambling violations that are of a natural nature, that is, claims from these offenses are not subject to judicial protection.

One of these offenses is provided for in the second part of paragraph 2 of Article 932 of the Civil Code of the Republic of Belarus, which states that in the event of a game organizer’s refusal to hold a gambling game within the prescribed period, game participants have the right to demand from their organizer compensation for real damage incurred due to the cancellation games or postponing them. Based on this, it follows that game participants, in the event of the organizer’s refusal to hold the game, have the right to demand the return of their bets.

Based on the fact that gambling is a contract concluded under a condition, we can say that the Civil Code of the Republic of Belarus establishes two more violations of gambling.

Thus, in accordance with part one of paragraph 3 of Article 158, if the occurrence of an event was prevented in bad faith by a party for whom the occurrence of the event is unprofitable, then the event is recognized as having occurred. Consequently, if a participant or organizer who loses during a gambling game in bad faith (or in a bet - in any way) influences the outcome of the game, then this participant or organizer is recognized as a loser, and the player who wins during a game must be recognized as a winner. However, the question arises of who should be recognized as the winner if, during the course of the game, several persons have equal (or almost equal) chances of winning and it is impossible to determine one winner. In this case, in my opinion, the winning amount should be divided evenly among the winning participants.

In accordance with part two of paragraph 3 of Article 158 of the Civil Code of the Republic of Belarus, if the occurrence of a condition was facilitated in bad faith by a party to whom the occurrence of the event is beneficial, then the condition is recognized as not having occurred. Therefore, if a participant or organizer of a gambling game violates established rules games with the aim of the occurrence of an event beneficial to him (recognizing him as a winner), then he is not recognized as a winner. However, based on the fact that the event that determines the winner of the game, in accordance with this norm, is considered not to have occurred, then there is no winner of the game. That is, the game is considered not to have taken place and all its bona fide participants must have their bets returned.

To summarize this paragraph, it can be noted that for violations related to the organization and conduct of gambling, not only civil, but also administrative and criminal liability is provided. Despite the fact that gambling is recognized as a natural contract, the Civil Code of the Republic of Belarus establishes two violations for which the claims arising from them can be protected in court. Also, the Civil Code of the Republic of Belarus establishes gambling violations, claims for which are not subject to judicial protection. It should be noted that in accordance with Order of the Ministry of Sports and Tourism of the Republic of Belarus No. 1698, disputes arising in connection with gambling may be subject to consideration special commission Expert Council Belarusian Gambling Association. Also, the natural nature of this agreement, which is established by law to create unfavorable conditions for organizing and conducting gambling, provides the opportunity to use non-judicial methods of protecting rights and, first of all, self-defense of rights. And from self-defense to arbitrariness there is only one step.

To summarize the first chapter of this course work, can be done the following conclusions. Firstly, Chapter 57 of the Civil Code of the Republic of Belarus “Games and betting” regulates only risk-based games aimed at obtaining property winnings (gambling). Moreover, depending on the possibility or impossibility of influencing the outcome of the game, all gambling games are divided into gambling (in the narrow sense of the word) and betting. Secondly, gambling is predominantly a public, real, conditional contract, which has a risky, bilaterally binding, reimbursable nature and is recognized as a natural obligation, which is expressed in the features of responsibility in gambling. Thirdly, the subject of gambling is the possible winnings, which is essential condition agreement, and, depending on the subject composition, it is possible to distinguish between gambling conducted between the organizer and the participant and gambling concluded only by individual participants.

At the same time, the features of this agreement make it possible to distinguish it as an independent type of obligation. However, two types of gambling (games and bets) have their own specific features V legal regulation, which will be discussed in the next chapter.

From behind my shoulder I heard thin voice friends: “Damn, I’m scared!” This phrase was reflected in smiles on the faces of the others. I thought: we’ve come to the right place, all these cinemas, bars, cafes, bowling alleys - everything is already boring, but here is something new, something that evokes that childish feeling of total delight.

And now our time has come. We were taken into the next room to get acquainted with the background story. The nuclear physicist took some of his scientific miracles out of his sleeve and clicked a couple of buttons in the darkness; an image lit up on the wall. We were led into a completely dark room, wished good luck, and the door closed.

There was a loud clicking sound. The floor began to flash, then higher and higher, and now we were blinded by the enveloping bright light of the teleport, the sound was growing, the light was becoming brighter. We stand in the circle of the teleport, huddled close to each other, and the light right around us rises in waves and suddenly suddenly goes out, the sounds stop. The far end of the room was dimly lit. Gradually getting used to the darkness after such an epic teleport, we, holding each other, moved forward to our salvation. We had to make our way through the surgical experiment room, offices, corridors, look for all kinds of clues, reports, reports, solve logical riddles, and, of course, control the time machine. By the way, there are 4 options for completing your journey to the past and only 1 chance to survive.

It was only in the car on the way home that we were able to start talking. Only 60 minutes of game time, but it feels like we really have now visited the past and spent at least a week there, trying to survive. And in my head there are only those logical riddles and one phrase: “Well, of course... it was so logical.” It’s good to sometimes leave a group of nice people like this real world with all its problems and test your resilience on the path to survival.”

Every week in Veliky Novgorod, intellectual games “60 seconds” are successfully held, where those who want to have a fun and interesting time gather in different leagues. Club branches are open in Russia and abroad, and are incredibly popular among Russians in Cyprus. In our city, this game was organized by Evgeny Lukin, and not so long ago the Novgorod club “60 Seconds” won the competition for young entrepreneurs in the “Discovery of the Year” category. What is a quiz, why are intellectual games so popular, and what will intellectuals from Staraya Russa, Borovichi and Malaya Vishera soon be playing? Zhenya, tell us what a quiz is, and how this game differs from “60 seconds”?

Quiz is a quiz that originated in English pubs in the 60s of the last century. This is a fairly relaxed format: people eat, communicate, and answer questions along the way. The quiz format is simpler than “60 seconds”, more accessible in terms of perception of the material, it is a more relaxed bar option. The quiz consists of three blocks. The first and third blocks have 20 questions each, the second - 30 questions. Now the quiz takes place once a week, from 45 to 100 people gather.

These are two intellectual games. Won't they compete with each other?

The fact of the matter is that these are different formats. Those who like to play 60 Seconds do not like to play quizzes. They often don't like guessing questions. Quiz is more of a quiz with media questions, pictures, videos and audio files.

Where will you launch the project?

Novgorod players were the first to try their hand at this game. The game was launched in Moscow, 10 more cities in soon waiting for the start of the quiz: Tver, St. Petersburg, Ivanovo, Kaliningrad and others.

Unlike “60 seconds,” which is played in 50 cities around the world, the “Play with your head” quiz is currently taking place only in Moscow and Veliky Novgorod. The organizers of the game were the creators of the game “60 Seconds”, since there is no crisis network in Russia. And we came up with our own crisis - Leonid Edlin, president of the 60 Seconds club, Kirill Radchenko, Ekaterina Andreeva and me. And now we are launching it throughout Russia. How did you come up with the idea to do a project with your Moscow colleagues?

We see that throughout Russia there is a huge demand for intellectual games. Quiz tests are opened in cities, but this is not systematic; often the quality of the material is quite low. We have a lot of content that is not used in the 60 Seconds game, these are various media materials. In addition, we have many authors both in Russia and abroad who provide quality questions. In addition, we see that there are players who are not yet ready to play “60 seconds”.

How can you characterize the audience of the “Play with your head” quiz?

Like the 60 Seconds players, people over 30 who want some light entertainment for the evening with the opportunity to win some prizes for knowing some facts. Questions about dog breeds, TV series, women's fashion and other topics.

A couple of years ago quests came to Veliky Novgorod, almost a year ago the game “60 seconds” appeared, now there is a quiz. Can you predict what games will be popular in Veliky Novgorod in a year?
I can’t predict, but I’m saying for sure that now is not even the peak intellectual entertainment in small and large cities of Russia. This format still has serious potential for growth: we are not represented either in Okulovka, or in Pestovo, or in Borovichi, or in Staraya Russa...
